1. General provisions

These terms set out how the MySkillsSpace service may be used, and the rights and obligations of its users and of the provider. The provider's full identification details, registered address and registration numbers are published on the Contact page.

MySkillsSpace is a place to publish and to find professional services. A specialist publishes a profile and priced services; anyone can browse them; a signed-in company can save a profile, send an invitation and start a conversation. The provider is not a party to whatever the two sides then agree, does not take payment for their work, does not hold their money and is not a recruitment agency.

An account, a profile, publishing services and browsing content are free. The service carries no advertising and no sponsored placements, and no one can pay to appear higher in results.

2. User accounts

Creating an account requires an e-mail address and a password. An account is either a specialist account or a company account; the role determines the available features. Accounts are intended for people aged 16 or over.

Users undertake to provide true and current information and not to share account access with third parties. They are responsible for actions taken through their account.

A user may delete their account at any time from the settings, after confirming their password. Deletion immediately anonymises the account and the profile, removes published services, work history, documents and saved items, deletes uploaded files from the server and ends every session. An emptied, anonymised record of the account remains so that other people's conversations and records stay intact. Messages already sent to another user stay in that person's conversation. The Privacy Policy sets this out in full.

3. Published content

A professional publishes their profile and services on their own responsibility, and describes the scope, the form of engagement and the pricing accurately. Where job listings are available, an employer publishes a listing on the same basis and confirms they are entitled to recruit for the stated role.

A professional decides which parts of their profile and services are public and which are visible to signed-in companies only, and may withdraw them at any time.

Unlawful, discriminatory or misleading content is prohibited, as is any published content that requires a payment from the professional.

4. Moderation and content removal

The provider may restrict, suspend or remove content that breaches these terms or the law, and may suspend an account. Where content that was published is restricted, the author is told what was restricted and on what grounds, through a notice in the service.

Anyone, whether or not they have an account, may report content they consider unlawful or in breach of these terms, using the contact form and choosing the topic for reporting illegal content. A report should identify the content precisely, for example by its address in the service, and explain why it is considered unlawful. Reports are handled without undue delay.

A user who disagrees with a decision may contest it through the contact form. The provider will re-examine the decision and reply; a decision that turns out to be wrong is reversed. Nothing here limits the right to take the matter to a court or another competent body.

5. Liability

MySkillsSpace is an intermediary platform: it is not a party to any agreement between a specialist and a company, does not guarantee that work will be found or awarded, and does not verify the truth of what users publish.

The provider is not responsible for the content of user-published profiles and services, nor for decisions taken on their basis, but does act to remove content that breaches these terms once it is aware of it.

The provider aims to keep the service continuously available, reserving the right to technical breaks needed for maintenance and development.

Competency assessments are tools made available to companies as they are. A company that attaches an assessment to an invitation confirms that it has reviewed the assessment's scope and selects it for its relevance to the role, and remains solely responsible for how the results are used in its recruitment, including the duty not to discriminate. The provider does not warrant that an assessment is suitable for a particular role and never makes a recruitment decision; a candidate is shown the scope of every assessment and consents before any assessment starts.

The provider reviews the assessment question bank continuously. A candidate may report a question from inside an assessment; a question confirmed as flawed is excluded from the score of every attempt that contained it. Results remain evidence for a decision made by people, never a decision in themselves.

6. Personal data

How personal data is processed, on what legal basis, for how long, and what rights data subjects have is described in the Privacy Policy, which forms an integral part of these terms.

7. Complaints

Complaints about the service can be submitted through the contact form. A submission should describe the problem and include details allowing a reply.

A reply is sent to the submitter's e-mail address within 14 days of receipt. A user who is a consumer and is not satisfied with the outcome may pursue out-of-court dispute resolution; the provider is not obliged to use any particular entity, and any entity it commits to will be named here. Consumer rights under mandatory law are not affected by these terms.

8. Changes to these terms

The provider may change these terms for important reasons, in particular a change in the law, a change in the scope of the services offered, or a change in how the service works.

Account holders are notified of a change through the service or by e-mail before it takes effect, at least 15 days in advance for users who publish services in a professional capacity, and at least 14 days in advance for other users. A user who does not accept the change may delete their account at no cost; a business user may waive the notice period.

The version in force is identified by the effective date shown on this page. A change that only corrects wording, without altering rights or obligations, does not restart the notice period.

9. How results are ordered

Results are ordered by the criterion the visitor selects. The default is the date a service was published or last updated, newest first. The alternatives are price, ascending or descending, and stated availability. Where the visitor has chosen a category, only services filed in that category or beneath it are shown.

The main parameters are therefore recency, the visitor's chosen sort, and the visitor's category and location filters, in that order of importance. Recency is the default because a marketplace of professional services is most useful when what is shown is still on offer. No parameter is influenced by any payment, and there is no promoted, boosted or sponsored placement of any kind.

A percentage may be shown beside a service. It is a fixed calculation over information the specialist published - how complete the profile is, whether skills, a price and availability are stated - and it does not affect the order of results. It is not a judgement of quality or suitability, and it is not produced by artificial intelligence.

10. Your content and your data

Content published by a user remains theirs. By publishing it, the user grants the provider a non-exclusive, royalty-free licence to store, display and make it available within the service, for as long as it is published, solely so that the service can show it to the people the user chose to show it to.

A user can read everything they have published from within their account, and can download a copy of their account data as a file at any time, including after they stop using the service and until the account is deleted. The provider does not sell user data and does not give another user access to data beyond what the visibility settings allow.

11. Governing law and disputes

These terms are governed by Polish law and the service is operated from Poland. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the law of the country where you are habitually resident: whichever rules protect you more are the ones that apply.

A dispute that cannot be settled through the complaints route in clause 7 may be brought before the courts having jurisdiction under the applicable law. For a consumer, that includes the courts of their own country of residence.
